Protests of Kane County Water Conservancy District
Water Right Change Application
Below are links to the protests and requests for hearing in response to the Kane County Water Conservancy District's (KCWCD's) March 30, 2009, Application for Permanent Change for Water Rights for Water Rights 89-74, 89-1285, and 89-151. KCWCD proposed to change the point(s) of diversion, place of use, and nature of use for 29,600 acre feet of water (over 26.5 million gallons per day) that will be withdrawn from the Green River. The water is to be used for the Blue Castle Holdings Inc. (formerly known as Transition Power Development LLC) proposed 2-unit nuclear power reactor, the "Blue Castle Generation" nuclear power station, near Green River, Utah. KCWCD leased the water rights to Transition Power in 2007. The protests were due on May 26, 2009.
The State Engineer has forwarded the water rights protests to the KCWCD for their response by June 16, 2009. As of July 14, no reply had been sent to the protestors. The Division of Water Rights has not set a date for the hearing, which will take place in Green River. In addition to this protest, there were protests of the KCWCD's request for an extension of time to show proof of beneficial use of the water that is the subject of the change application. No hearing date has yet been set for those protests.
Protestors brought forth a number of concerns and reasons why the change application should be denied.
A hearing on the protests of the San Juan and Kane County Water Conservancy Districts' request to transfer water rights (total of 53,6000 acre-feet) to the Green River for the proposed Blue Castle Project was held on January 12, 2010, in Green River. Additional testimony was submitted by the parties on or before March 1, 2010.
